Agreement to Terms

By accessing and using MEGA Marketing's website design services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Description

MEGA Marketing provides professional website design and development services for service businesses. We offer both Standard ($497) and Premium with Branding ($997) packages, which include website design, development, and delivery within 7 business days.

90-Day Sprint Program

Our sprint engagements are separate from the website packages above. They run in rolling 90-day blocks, billed monthly, with your media spend paid directly to the platforms and not included in our fees.

• Targets and roadmap deadlines are agreed with you in writing in week one of each sprint, and we report against them for the life of the sprint.
• Our fees cover our work only. They do not include media spend, third party platform fees, or costs payable to anyone other than MEGA Marketing.
• Either party may end the arrangement at the close of a sprint block. Work already delivered and fees already invoiced are not refundable.

Payment Terms

• Payment is required upfront before work commences
• All prices are in Australian Dollars (AUD)
• Prices include GST where applicable
• Payment can be made via the methods specified during checkout

Hosting & Subscription Terms

Hosting is billed monthly at $39/month via the payment method provided at checkout. This is a recurring charge that will continue until cancelled.

You may cancel at any time by notifying us in writing before your next billing cycle. Access to hosting, support, and content updates will cease if your subscription is not renewed.

Support Services

Ongoing support includes website content updates and basic technical assistance related to your website. This covers text updates, image swaps, font and color adjustments.

Support does not include third-party tools, domain management, email configuration, or complex custom features beyond the scope of your original package.

Delivery Timeline

We commit to delivering your website within 7 business days of receiving all required information and content from you. Delays in providing necessary materials may extend the delivery timeline.

Revisions

We aim to get your website right the first time based on the information you provide during onboarding. Every Site comes with unlimited content revisions so you can update text, swap images or tweak fonts and colours anytime, even after launch.

Just email our team and we'll handle it.

Need major design changes or a full site overhaul? We'll quote that separately if needed. But for everyday edits, it's all included.

Content and Materials

You are responsible for providing accurate and legal content for your website. You warrant that you have the right to use all materials (text, images, logos) provided to us and that they do not infringe on any third-party rights.

Domain Management

You are responsible for registering and managing your domain name unless a domain upgrade is purchased as part of your package. We can point your domain to your new website once you provide the necessary credentials and access.

Intellectual Property

Upon full payment of the setup fee, you own the rights to your website content and design. Your live website is hosted and supported by MEGA Marketing as long as your hosting subscription remains active.

MEGA Marketing retains the right to showcase your website in our portfolio or marketing materials to inspire other business owners, unless you specifically request otherwise (just let us know).

Want to move your site to your own hosting later on? We can help you migrate everything for a small one-time fee of no less than $397. Just reach out when you're ready.

Non-Payment & Account Suspension

If hosting payment fails, we will notify you via email at the address on file. If payment is not received within 7 days of the due date, your website may be temporarily disabled.

After 30 days of non-payment, we reserve the right to remove the website files from our servers. We strongly recommend backing up your content before cancelling or if you anticipate any payment issues or contact us and we can help you migrate everything for a small one-time fee of no less than $397. Just reach out when you're ready.

Limitation of Liability

MEGA Marketing will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the service.

Termination

We reserve the right to refuse service or terminate a project if you violate these terms or provide false information.

Refund Policy

Due to the custom nature of our work, we do not offer refunds once work has commenced. This includes situations where the design brief has been reviewed and development has begun.

If you cancel before we start working on your project, a partial refund may be considered at our discretion. Please contact us to discuss your specific situation.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page.
